Terms of service

Agreement

These Terms govern use of DanceFitness.fit (the "Service") by your dance studio ("you", "your"). By creating an account or using the Service, you agree to be bound by these Terms.

What the Service does

DanceFitness.fit provides a real-time class energy display for dance studio TVs. The Service estimates movement intensity and calorie burn for the class from a webcam. The video is analysed on the studio's own computer and is never streamed or recorded. Class statistics, and up to five highlight photos per class if you turn them on (see Member privacy below), are stored in a dashboard for authorised studio owners and staff. Calorie figures are estimates, not medical or fitness advice.

Plans & pricing

Plans available at launch:

• Single studio — $199 / month, one TV display, unlimited sessions.
• Annual — $1,990 / year (equivalent to two months free).
• Multi-location — $149 / month per location for three or more locations, by written arrangement with us.

Prices are in US dollars and exclude any applicable taxes. New studios get a 30-day free trial with no card required. If you haven't subscribed when it ends, the TV display keeps working for 7 more days and then stops until you subscribe.

Billing

Payments are processed by Stripe, monthly or annually, in US dollars. Plans renew automatically until cancelled. You can cancel at any time from your dashboard (Settings → Manage billing); the Service continues through the end of the period you have paid for. Annual plans can be refunded pro rata within 30 days of payment: email us. If a renewal payment fails, Stripe retries it for up to about two weeks and the Service keeps working meanwhile; if it still fails, the TV display stops until the card is updated.

Hardware & setup

You are responsible for providing the TV, webcam, and internet connection at your studio. Recommended specifications and a setup checklist are provided during onboarding. If a webcam or other hardware fails, the Service cannot function but no refund is owed for outage caused by your hardware.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code
• Resell or sublicense access without written permission
• Run the Service on premises where students have not been informed about AI motion sensing

Member privacy

You must tell your members (students) that a camera and AI motion sensing are used in class before you use the Service, for example with a sign at the entrance and a mention at the start of class. Highlight photos are taken only after you confirm in Settings that members have been told, and you can switch them off at any time (for example for children's classes). Class recap pages you share can be opened by anyone with the link. Detailed handling of personal data is described in our privacy policy.

Service availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance is announced in advance. The Service is provided "as is" during the pilot phase; an explicit SLA may be added once the product reaches general availability.

Limitation of liability

To the fullest extent permitted by law, DanceFitness.fit's total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including but not limited to lost membership revenue, lost business opportunities, or hardware damage.

Termination

You can stop at any time by cancelling (see Billing). We may end the agreement with 30 days' written notice, or suspend access immediately if you materially breach these Terms or your account presents a security risk. After your account closes, we delete your data within 30 days of your request (or delete it yourself at once in Settings → Delete your studio), subject to legal retention requirements (for example invoices).

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Toronto, Ontario.

Changes

We may update these Terms with at least 30 days' notice by email to studio owners. Continued use after the effective date constitutes acceptance.
